Diritto Negato. No al licenziamento obbligato nella UBA

Estimados Profesores, Investigadores, y colegas del quehacer intelectual y científico de todos los países.
Solicitamos vuestro pronunciamiento personal e institucional y que divulguen este pedido.
Nos dirigimos nuevamente a ustedes a fin de poner en vuestro conocimiento y recabar vuestra solidaridad frente a la gravísima situación que atraviesa la Universidad de Buenos Aires.
El Rectorado de la Universidad de Buenos Aires insiste en desconocer la ley y pretende cesantear a cientos de docentes.
En éste momento más de 700 profesores, y en los próximos meses cientos de profesores más, se encuentran ante la amenaza directa de ser despedidos de sus cargos por el Rectorado de la UBA, en un acto ilegal, brutal y arbitrario que agrede sus condiciones de vida, pero que, además, constituye un acto de abierta destrucción de la Universidad Pública.
Brevemente:
- Hace tres años los docentes universitarios argentinos conquistamos, tras arduo reclamo y movilización, la Ley de Jubilación para los Docentes e Investigadores por votación unánime del Congreso Nacional.
- En lo fundamental, la ley establece un salario del 82% del último haber para el colega que se jubile (antes no llegaba al 50%) y la actualización del mismo según el salario de los activos. Y el derecho de docentes e investigadores a optar por continuar en sus labores hasta los 70 años al alcanzar los 65 años de edad.
- Este derecho permite, por un lado, que muchísimos docentes, perseguidos por la dictadura, alcancen la antigüedad para acceder a la jubilación. Por otro, preservar en la Universidad Pública cátedras, equipos, proyectos y saberes de sus más destacados y experimentados integrantes.
- Las autoridades de la Universidad de Buenos Aires, son las únicas que no aplican la ley en el país y pretenden desconocerla cesanteando a todo docente o investigador que llegue a los 65 años. Una política de ajuste y mercantilización que pretende encubrirse con el argumento (nada menos) de la autonomía, conquista de la Reforma del ’18 obtenida justamente para garantizar la más amplia vida democrática al interior de la Universidad y vincularla al progreso social.
La comunidad universitaria de la UBA se encuentra masivamente movilizada para impedir este atropello y la destrucción de la Universidad Pública.

To the International Academic Community:
Dear Professors, Teachers, TAs, Researchers and colleagues from the intellectual and scientific field from all the countries: We are requesting you to provide your personal and institutional opinion on this matter and to spread this request.
We are contacting you once again in order to let you know and with the aim of getting your support for the extremely serious situation the University of Buenos Aires is currently going through.
The Head of the University of Buenos Aires insists on ignoring the law and is willing to dismiss hundreds of teachers[1].
At this very moment over 700 professors, and in the following months hundreds more, are facing the Head’s direct threat of being fired from their jobs, in an illegal, brutal and arbitrary action which doesn’t only undermine their living conditions, but it also constitutes an act of open destruction of our Public University System.
Briefly:
- Three years ago, Argentinean university teachers obtained, after a lengthy claim and mobilisation, the Teachers’ and Researchers’ Retirement Law by a unanimous vote of the National Congress.
- Fundamentally, the law establishes a pension of 82% of the last salary the retiring colleague perceived (before this it didn’t even reach 50%) and its indexation according the active teachers wage. And it also determined the researchers’ and teachers’ right to choose once they become 65 years old to continue their work until an age of 70.
- On the one hand, this right allows many teachers, who were under the military dictatorship’s pursuit, to reach the necessary amount of work years to have access to a pension. On the other hand, it allows the preservation of the most distinguished and experienced academic chairs, teams, projects and knowledge in the Public University System.
- The authorities of the University of Buenos Aires are the only ones who are not applying this law in the whole country and they mean to openly ignore it by firing every single teacher or researcher who becomes 65. This is a budget reduction and commoditization policy which is being masked with the argument of (unbelievably, no less) preserving autonomy, one of the conquests that the University System Reformation from 1918 got precisely with the aim of guaranteeing a broader democratic life within the University and of linking it to social progress.
The academic community of UBA is massively mobilised to stop this outrage and the destruction of the Public University System.

Chiar.mi Professori, Ricercatori e colleghi del mondo intellettuale e scientifico di tutti i paesi. Chiediamo una vostra presa di posizione personale e istituzionale affinché si diffonda questo comunicato.
Ci rivolgiamo a voi con il fine di mettervi al corrente ed avere la vostra solidarietà di fronte alla gravissima situazione che sta attraversando l’Università di Buenos Aires.
Il Rettorato dell’Università di Buenos Aires persiste nell’eludere la legge e pretendere la cessazione dal servizio obbligata di centinaia di docenti.
In questo momento più di 700 professori, e nei prossimi mesi saranno centinaia in più, si trovano di fronte alla minaccia diretta di venire rimossi dai loro incarichi dal Rettorato della UBA. Un’azione illegale, brutale ed arbitraria che incide sulle loro condizioni di vita e che costituisce una atto di evidente distruzione dell’Università Pubblica.
Brevemente:
- Da tre anni i docenti universitari argentini, dopo ardue rivendicazioni e mobilitazioni, hanno ottenuto l’approvazione della Legge di Pensionamento per i Docenti e Ricercatori per votazione unanime del Parlamento.
- La legge stabilisce: una retribuzione pari all’82% dell’ultimo stipendio per il collega che va in pensione (prima non arrivava al 50%); l’adeguamento retributivo concorde allo stipendio dei colleghi in attività, ed il diritto di docenti e ricercatori, come scelta opzionale, di restare in servizio fino ai 70 anni dopo aver compiuto i 65 anni di età.
- Questo diritto permette, da un lato, che moltissimi docenti perseguitati e destituiti durante la dittatura, raggiungano gli anni di anzianità per accedere alla pensione, dall’altro, di conservare nell'Università Pubblica le cattedre, i gruppi di ricerca, i progetti e le conoscenze dei suoi membri più prestigiosi.
- Le autorità dell’Università di Buenos Aires sono le uniche nel paese a non applicare la legge e pretendono di eluderla obbligando la cessazione dal servizio per tutti i docenti che compiano i 65 anni. Una politica di tagli e mercificazione che cerca di mimetizzarsi utilizzando come pretesto l’autonomia dell'università pubblica. Un'autonomia conquistata nella Riforma del 1918, ottenuta invece, a ragione, per garantire maggiore democrazia all’interno dell’università e vincolarla alle conquiste sociali.
La comunità universitaria della UBA si trova mobilitata in massa per impedire questa aggressione e la distruzione dell’Università Pubblica.

Dirigimo-nos novamente a vós a fim de pôr en vosso conhecimento e obter a vossa solidariedade frente à gravíssima situação que atravessa a Universidade de Buenos Aires.
O Reitorado da Universidade de Buenos Aires teima em desconhecer a lei e pretende deixar cessantes a centos de docentes.
Neste momento mais de 700 professores, e nos próximos meses mais centos de professores, encontram-se perante a ameaça direta de ser demitidos de seus cargos pelo Reitorado da UBA, em um ato ilegal, brutal e arbitrário que agride suas condições de vida mas que, além disso, constitui um ato de aberta destruição da Universidade Pública.
Brevemente:
- Faz três anos os docentes universitários argentinos conquistamos, depois de árduo reclamo e mobilização, a Lei de Aposentadoria para os Docentes e Pesquisadores por votação unânime do Congresso Nacional.
- No fundamental, a lei estabelece um salário do 82% do último haver para o colega que se aposente (antes não chegava ao 50%) e a atualização do mesmo segundo o salário dos ativos. E o direito de docentes e pesquisadores a optar por continuar em suas tarefas até os 70 anos ao atingir os 65 anos de idade.
- Este direito permite, por um lado, que muitos docentes, perseguidos pela ditadura, alcancem a antiguidade para aceder à aposentadoria. Por outro, preservar na Universidade Pública cátedras, equipes, projetos e saberes de seus mais destacados e experimentados integrantes.
- As autoridades da Universidade de Buenos Aires, são as únicas que não aplicam a lei no país e pretendem desconhecer deixando cessante a todo docente ou pesquisador que chegue aos 65 anos. Uma política de ajuste e mercantilização que pretende se encobrir com o argumento (nada menos) da autonomia, conquista da Reforma do ’18 obtida justamente para garantir a mais ampla vida democrática ao interior da Universidade e vinculá-la ao progresso social.
A comunidade universitária da UBA encontra-se massivamente mobilizada para impedir este atropelamento e a destruição da Universidade Pública.
